Abu Dhabi Court of First Instance for Family and Civil and Administrative cases obligated a manager of a company to pay another person Dhs200,000, which was given to him as a deposit but he seized the amount.
The court also obligated the manager to pay the plaintiff Dhs5,000 in compensation for the material and moral damages incurred, as well as the fees and expenses of the case.
The appellee stated in his memorandum that the amount was due to a commercial contract concluded between the plaintiff and his company, and it was drawn up as a guarantee for the plaintiff’s right.
The appellee did not provide the court with evidence that the debt was due to a commercial contract between him and the plaintiff, as the receipt did not mention any commercial transactions,
So the court rejected it and obligated him to repay Dhs200,000 to the plaintiff, in addition to Dhs5,000 in compensation for all damages incurred.
