Man to get Dhs315,000 as compensation in fodder case

The Al Dhafra Primary Court obliged a person to pay another Dhs315,000, after the latter agreed with the first person to transport fodder in return for money over several years, totalling to Dhs315,000, but when asked to repay, the appellee refused.
The details of the case date back to the time when a person filed a lawsuit against another, requesting the court to oblige him to pay Dhs315,000, take an oath if he denies the claim, and pay the fees and expenses of the lawsuit.
The plaintiff stated that he agreed with the appellee to transport fodder to his farm for the said amount over several years, and when asked to repay, the appellee refused.
The plaintiff submitted a photocopy of a manual account statement but not signed by the appellee so the court made the appellee take the oath.
Both parties attended the hearing, with the appellee’s lawyer who acknowledged that his client owed the plaintiff only Dhs112,000 and the appellee refused to take the oath.
The lawyer also requested the dismissal of the case and the waiver of the debt due to the passing of five years while the plaintiff affirmed that the documents supported his statements.
The court clarified that since the appellee refused to take the oath, the dispute was conclusively settled.
Given that the appellee did not provide evidence of his innocence, he was obliged to pay the plaintiff Dhs315,000.
Recently, the Abu Dhabi Court for Family, Civil and Administrative Cases obligated a person to return Dhs250,000 to a woman, which he had taken from her as a loan but when she asked him to return it, he refused.
The woman proved that through chats via WhatsApp and the testimony of one of the man’s wife relatives.
In the details, a woman filed a lawsuit against a person, in which she requested that he be obligated to pay her Dhs250,000 and obligate him to pay the fees and expenses of the case.
She explained that the appellee asked her for the amount as a loan because he was going through financial hardships, so she deposited the amount in his account, and when she asked him to return it, he refused.
The plaintiff attached a copy of the deposit receipt and of WhatsApp chats with the case papers.
